The Ruling on Selling the Skins of Qurban

In performing qurban, Muslims are faced with many questions about the rulings and procedures of its implementation. One of the most common questions is ‘is it permissible to sell the skin of the qurban animals?’. This question arises from the fact that the skin is one of the parts of the qurban that is difficult to process and not desirable for many people. This article will discuss the scholarly opinions on this issue and the evidence that supports these opinions. 

The opinions of the scholars on the ruling on selling the skins of qurban animals.

A. Haram

According to the majority of scholars from the Shafi’i, Maliki, and Ahmad madhhabs, as well as Abu Yusuf from the Hanafi madhhab, it is haram to sell the skins, bones and nails of the qurban animals. This is based on several proofs, which are: 

A hadeeth narrated by Abu Hurairah Radhiyallahu anhu in which the Prophet Muhammad ﷺ said:  

عَنْ أَبِيْ هُرَيْرَةَ أَنَّ رضسُو لَ اللّه صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ : مَنْ باعَ جِلْدَ أُضْحِيَّتِهِ فَلاَ أُضْحِيَّةَ لَهُ 

‘Abu Hurairah (may Allah be pleased with him) reported that the Prophet Muhammad (peace and blessings be upon him) said: Whoever sells the skin of his qurban animal, there is no qurban for him’ (narrated by al-Hakim and al-Baihaqi).

A hadith narrated by Ali ibn Abi Talib Radhiyallahu anhu:

أَمَرَ نِي رَسُولُ اللّه صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ أَقُومَ عَلَى بُدْنِهِ وَأَنْ أَتَصَدَّقَ بِلَحْمِهَا وَجُلُودِهَا وَأَجِلَّتِهَا وَأَنْ لاَ أُعْطِيَ الْجَزَّارَ مِنْهَا قَالَ نَحْنُ نُعْطِيهِ مِنْ عِنْدِنَا

‘The Prophet Muhammad (peace and blessings of Allah be upon him) commanded me to take care of his qurban camels, to give in charity their meat, skins and lint. And that I should not give anything to the slaughterer. And he (peace and blessings of Allaah be upon him) said: ‘We will give the butcher from us.’ (Muslim narrated 348, 1317) 

A hadith narrated by Abu Said Al-Khudri Radhiyallahu anhu:

(…وَلاَ تَبِيْعُوْا لُحُوْمَ الْهَدْيِ وَاْلأَضَا حِي فَكُلُوْا وتَصَدَّقُوْا وَاستَمْتِعُوْا بِجُلُودِهَا وَلاَ تَبِيْعُو هَا….) 

‘Do not sell the meat of the hadiy and qurban. But eat it, give it in charity, and take pleasure in its skin, but do not sell it’ [Dha’if hadith, narrated by Ahmad 4/15]. 

Based on the above hadeeths, the majority of scholars are of the view that selling the skins of qurban animals is haraam. 

B. It Is Permissible, but The Proceeds Must Be Given In Charity

However, some scholars, including Abu Haneefah, were of a different opinion. They are of the opinion that selling the skins of qurban animals is not haram, but the proceeds must be given in charity. This opinion is based on the understanding that the use of the qurban animal can be done in various ways, including selling the skin. 

Allah ﷻ says in QS. Al Hajj verse 28 :

يَشْهَدُوا مَنَافِعَ لَهُمْ وَيَذْكُرُوا اسْمَ اللَّهِ فِي أَيَّامٍ مَعْلُومَاتٍ عَلَىٰ مَا رَزَقَهُمْ مِنْ بَهِيمَةِ الْأَنْعَامِ ۖ فَكُلُوا مِنْهَا وَأَطْعِمُوا الْبَائِسَ الْفَقِيرَ

So that they may see the benefits for them and that they may mention the name of Allah on the appointed day for the sustenance which Allah has given them in the form of livestock. So eat some of it and give some to the poor and needy. (QS Al-Hajj:28) 

From the above verses and hadiths, it can be understood that the main purpose of the qurban is to benefit mankind, especially those in need. Therefore, if selling the skins of the qurban animals can provide more benefit to mankind, then some scholars are of the opinion that it is not prohibited

C. Permissible Without Any Limitation

This is the view of Abu Tsaur, but it is a weak view because it does not refute the hadeeth that forbids the sale of qurban skins, as mentioned in the first view.

Qurban is a great act of worship that is honoured by Allah, may He be glorified and exalted. Performing this honourable act of worship requires knowledge of the rulings relating to it, including the sale of the skins of the qurban animals. May Allah ta’ala grant us the ability and guidance to perform qurbani and accept our qurbani as additional good for us in the Hereafter.
